A residence permit is a document that not only allows you to legally stay in Ukraine, but also guarantees the civil rights of a foreigner. They, according to the Law "On Immigration", are equated with the rights of citizens.

Requirements for obtaining a residence permit

The requirements for the applicant when applying for a permanent and temporary residence permit differ significantly, but our specialists have prepared a generalized list of requirements that the applicant must meet below.

  1. The applicant must be in Ukraine legally;
  2. The applicant must have the appropriate grounds for obtaining a residence permit in Ukraine;
  3. The applicant must not have an outstanding criminal record on the territory of Ukraine;
  4. The validity period of the passport must be more than 6 months from the date of submission of documents.
  5. No criminal record in the country of citizenship of a non-resident (for quota categories);
  6. Absence of infectious and drug-related diseases (for quota categories).

Terms of obtaining a residence permit

The legislation of Ukraine provides for the maximum production time for applications:
· for obtaining a temporary residence permit - 15 working days;
· on obtaining a permanent residence permit - up to 1 year.

Advantages of a temporary residence permit

The rights of foreign citizens who have a residence permit in Ukraine practically do not differ from the rights and freedoms of Ukrainians. Exceptions are restrictions established by the Constitution of Ukraine, such as: the right to vote in elections and referendums or the right to serve in government agencies.

According to Article 4 of the Law of Ukraine "On the Legal Status of Foreigners and Stateless Persons", the grounds for obtaining a temporary residence permit are:
· employment, training or family reunification
· work as a correspondent or representative of foreign media
· participation in the implementation of international technical assistance projects
· conducting cultural, scientific, educational activities, volunteering
· work in branches and representative offices of foreign firms, banks and public organizations
· participation in the founders and/or participants, and/or beneficiaries of the owners of a legal entity registered in Ukraine
· canonical activity

Since the reasons for obtaining a residence permit in Ukraine are diverse, the validity period of a temporary residence permit for the relevant categories of foreigners will also differ:
· the period of study specified in the document confirming the fact of education in Ukraine
· the validity period of a work permit in Ukraine (from 6 months to 3 years) is the permitted period of temporary residence for labor immigrants
· the time required for the implementation of the international technical assistance project is for the participants of the program
· two years - for founders, participants, beneficial owners of a legal entity registered in Ukraine
· one year is the period for which a temporary residence permit is issued for foreigners in all other cases provided for by law

In connection with the introduction of the Unified State Demographic Register of Ukraine, registration and issuance of a temporary residence permit from 01.06.2018 is carried out in the format of a plastic card.

The process of obtaining a temporary residence permit

The process of obtaining a residence permit in Ukraine is complicated and includes many stages. Below we provide you with an approximate list of these stages.

1. The choice of a legal basis for obtaining a temporary residence permit.
2. Obtaining consent from the receiving party.
3. Collection of necessary documents for a national visa, which will be opened to you at the consulate.
4. Arrival in Ukraine to register the actual place of residence.
5. Collection of documents and certificates necessary for registration of a residence permit within one and a half months.
6. Submission of the entire package of necessary documents to the migration service.
7. Registration of a temporary residence permit in Ukraine will last from 1 to 3 months.

Documents required for registration of a temporary residence permit

The legislation of Ukraine provides for the following list of documents required for registration of a temporary residence permit in Ukraine:

1. Application from a foreigner or a stateless person;
2. Application for a residence permit in Ukraine from the receiving party;
3. Identity document;
4. Translation of the identity document into Ukrainian with notarization;
5. A copy and original of the immigration card or a copy of the passport page with a type "D" visa with a border crossing mark;
6. Documents on the availability of housing in Ukraine, where a person has the right to register;
7. 4 photos 3.5 x 4.5 cm on a matte base;
8. Receipt for payment of government services and state duty;
9. The document that is the basis for staying in Ukraine.

Important facts

· A temporary residence permit is issued to foreigners and stateless persons from birth.
· Citizens of Azerbaijan, Armenia, Belarus, Georgia, Moldova, Russia, Uzbekistan do not need a visa to obtain a temporary residence permit, however, all other foreigners are required to obtain a long-term type D visa to obtain a residence permit in Ukraine.
· An application for a temporary residence permit is submitted by foreigners who are legally located on the territory of Ukraine to the territorial bodies or divisions of the State Migration Service at the place of residence.
· A temporary residence permit is issued within fifteen working days from the date of receipt of the application for its registration or exchange of the type due to the expiration of the residence permit.
· No later than 30 calendar days from the date of obtaining a temporary residence permit, a foreigner is obliged to register his place of residence with state authorities.
